Pubblicazione legale: With regard to the system of limitation of the ship owners debts, Italy remained, for decades, anchored to the system regulated by the Navigation Code. Meanwhile, at the international level and within the EU, there were normative changes which Italian legislation never adopted. The legislator endeavoured to put an end to these gaps with the law decree no. 111/2012 which incorporated, albeit partially, the topics contained in LLCM and in EC Regulation 2009/392, purporting to summarize their most important aspects. However, rather than harmonizing the national legislation with the EU and the international norms, the text of the decree has created significant problems in the effective implementation of those rules, therefore making desirable a new intervention in the matter.
